These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Ai Photographer ("we," "us", or "our"), concerning your access to and use of the ai-photographer.com website and service.

You agree not to use the Service to generate content that:

• Is illegal, pornographic, hateful, or promotes violence.
• Infringes on the intellectual property or privacy rights of others.
• Depicts minors (children under 18) without explicit parental consent.
• Depicts public figures or celebrities without their consent ("Deepfakes").

We reserve the right to ban users and delete accounts that violate this policy without refund.

4. Biometric Data Consent

By uploading photos of yourself or others, you explicitly consent to the processing of biometric data for the sole purpose of generating AI photos. You confirm that you have obtained all necessary consents from any individuals depicted in your uploaded photos.

5. Payment & Refunds

Credits: Our Service operates on a credit system. Credits are purchased securely via Stripe.

Refunds: Due to the high cost of GPU processing, we generally do not offer refunds for credits used to generate AI models or images, as the computing resources have already been consumed. However, if a technical error on our end results in failure to generate any images, we will fully refund your purchase upon request.

6. Disclaimer of Warranties

The Service is provided on an "as-is" and "as-available" basis. While our AI technology is state-of-the-art, AI generation can be unpredictable. We cannot guarantee that every generated image will be perfect or resemblance will be 100% accurate.

7. Limitation of Liability

To the fullest extent permitted by law, Ai Photographer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Service.
